End User License Agreement (EULA)

1. Scope and Subject of Contract
This End User License Agreement (EULA) governs the use of the software "FCP Cleaner" ("Software"), developed by Lars Hasenbein / ankermann.tv.
The Software is designed to identify and delete specific files within Apple Final Cut Pro libraries (e.g., render files, optimized media, proxy files).
Important Note: This Software is not affiliated with Apple Inc. "Final Cut Pro" is a trademark of Apple Inc.
By installing, activating, or using the Software, you agree to be bound by this EULA. If you do not agree to these terms, you may not use the Software; in this case, the Software remains in a restricted Demo Mode without deletion functionality.
2. Scope of License
Upon purchase of a valid license, you are granted a simple, non-exclusive license to use the Software under the following conditions:
- A license entitles you to use the Software on one (1) Mac computer.
- Device changes (migration) are permitted, provided the license has been deactivated or removed from the previous device.
- The Software is licensed, not sold.
Publicly publishing or sharing the license key (Key-Sharing) is prohibited.
3. Activation & License Verification
The Software requires online activation to unlock its full functionality. The Software is entitled to validate the license status online at regular intervals.
In the event of suspected misuse (e.g., a license key used on a disproportionately high number of devices simultaneously or made publicly available on the internet), the Developer is entitled to block the license remotely.
4. Proprietary Rights
All copyright and intellectual property rights in the Software remain with the Developer. You are granted only the usage rights explicitly stated in this contract.
It is prohibited to:
- Modify, decompile, or reverse engineer the Software (unless expressly permitted by mandatory law, e.g., § 69e UrhG).
- Circumvent technical protection measures or activation routines.
5. IMPORTANT: Backup Duty & Data Risk
USE OF THE DELETION FUNCTION IS AT YOUR OWN RISK.
Since the Software interacts directly with the file structure of Final Cut Pro libraries, you obligate yourself to:
- Create a full backup of your Final Cut Pro libraries and projects before each use.
- Ensure that you can perform a restoration in case of an emergency.
- Only delete files if you are aware of the consequences.
The Developer assumes no responsibility for lost data, "Media Offline" errors, or damaged projects resulting from missing backups or improper use of the deletion function.
6. Limitation of Liability
6.1 Disclaimer of Liability: The Developer is not liable for damages caused by slight negligence, provided that no material contractual obligations (cardinal obligations) have been violated. This applies in particular to:
- Data loss or damage to video projects.
- Production downtime or loss of profit.
- Damages caused by incompatibility with future versions of macOS or Final Cut Pro.
6.2 Limits of the Disclaimer: The above limitations of liability do not apply to:
- Intent or gross negligence.
- Injury to life, limb, or health.
- Claims under the Product Liability Act (Produkthaftungsgesetz).
- Violation of material contractual obligations (cardinal obligations); in this case, however, liability is limited to the typically foreseeable damage.
7. Updates & Compatibility
The Developer endeavors to keep the Software current but guarantees no permanent compatibility with future versions of Final Cut Pro or macOS. Major functional expansions (Major Updates) may be subject to a new license fee.
8. Privacy & Reseller
The purchase process and license management are handled by the provider Lemon Squeezy. For license verification, the Software transmits technically necessary data (license key, anonymized hardware ID, IP address for fraud prevention) to the license server.
No further personal data is processed within the Software itself.

9. Right of Withdrawal
As this concerns digital content not supplied on a tangible medium, the right of withdrawal expires as soon as the user has started the performance of the contract (activation/download) and has agreed to the expiration of the right of withdrawal. Refunds in cases of goodwill are subject to the policies of the reseller (Lemon Squeezy).
10. Termination
The license ends automatically in the event of a violation of these terms. In the event of termination, you are obliged to cease use and delete the Software.
11. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the seat of the Developer.
Should individual provisions of this contract be invalid, the remaining provisions shall remain effective. The invalid provision shall be deemed replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
